The John I'm tracing in 1871 and 1881 is the son of James Thom and Margaret Paterson however James died in 1863 and Margaret in 1866.

I have a John Thom in 1871 and 1881 but I don't know if I have the same one in both census or if he is the one I want.

Yes, with the death of one it looks as though I have the right one in 1871 and 1881 although I have not proved the 'nephew' bit yet.

I can't find a birth abt 1841 for Margaret Paterson with mmn Miller/Millar.

Christian Miller was the widow of William Miller. They married 16 July 1841 in St Cuthbert's, Edinburgh. They had several children including Cecilia born 1860 (as per 1871 Census) and Catherine Miller born 1858 (as per 1881 Census). Christian's maiden name was Thom so I'm guessing a sister to John's father James. Haven't found the proof yet though.
